ANY payment received in full for any tour stipulated or agreed upon before or after such tour and either directly or through your agent, you will be deemed as our client and participant having understood our terms and conditions and forms part of the binding contract.
Access to HTPTours on the WWW is not guaranteed and is subject to availability of communications, links and possibly access rights.
Access rights provided to a specific person or group provides same with ability to log on as to maintain account, make, cancel or change a specific booking and HTPTours retains the right to deny login to this site to any account holder.
Accounts are to be kept in good standing and in accordance with our mutually binding agreement, for which all funds deemed payable are based on all outstanding bookings, minus commissions, and are due on the last day of each month, for any or all bookings arranged from the previous month.
Bookings made online are subject to confirmation and you as our client or agent, retain full rights to cancel, until such time where any booking is deemed confirmed.
Once a booking is confirmed, cancelations are not impossible but improbable and in most cases subject to the conditions of our suppliers.
All individuals departing or entering Canada must be in possession of a valid passport and that they meet all Visa requirements prior to booking a specific tour.
All Clients are responsible for both their lunch and dinner for each day out if not included in the itinerary, and all items of a personal nature such as telephone calls, beverages, laundry, gratuities, travel insurance or other items not specified.
Your acceptance of any tickets or receipts will be deemed as your acceptance of the above conditions and of any alterations made to your tour.
All our tours and its corresponding value as shown on our website or in advertisements are in Canadian Dollars and are fully inclusive of all taxes Agents or Professional fees may apply and these may vary between agents.
A surcharge may apply for credit card transactions.
We strongly recommend that all clients take out travel insurance.
Travels in outdoor environments may present risk to life and limb and such risks include, but are not limited to, natural disasters, forces of nature, isolation from help, difficult evacuation, equipment failure, human error and accidents involving injury, including death. It is understood that you as our client and participant will be participating at your own risk.
Notice is hereby given that all arrangements and services organized by HTPTours on behalf of the participants, are made on the sole condition that the owners, organizers, guides, photographers and staff shall not be held responsible for any injury, death, accident, delay, loss, damage or irregularity which may be occasioned through acts, including negligence, of any company and/or persons engaged in carrying on the arrangements and services described herein or otherwise connected herewith.
HTPTours has no liability for any loss or damage whether through negligence, act or omission or by any sales agent or other third party and neither for any bookings purchased directly by our client or any sales agents on behalf of passengers, further we reserve the right to cancel or modify itineraries or bookings where circumstances require.
In circumstances where HTPTours is liable, such liability is limited to the partial or full value only of the purchased travel arrangements.
Photographs and illustrations and other promotional material which may be found are used for advertising purposes only, and under no circumstances do they imply, nor should you as our client conclude each as points of interest and factual stops within a given tour.
All photographs taken on a specific tour are the property of the photographer or the company they represent, and under no circumstances do they relinquish those rights. Therefore each client hereby acknowledges adhering to the Personal Use License Agreement included with each DVD provided and herein included by following this link.
All tours are subject to availability and can be withdrawn without notice.
These terms and conditions will be governed in all respects by the laws of Canada in the province of Ontario, without reference to its laws relating to conflicts of law. Any disputes arising from this Agreement or its enforceability shall be settled by binding arbitration to be held in the City of Toronto in the province of Ontario, Canada.
If one or more of the provisions herein contained is found to be invalid, illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions shall not be affected. Such provisions shall be revised only to the extent necessary to make them enforceable by HTPTours or its appointed representatives.
